Description
CONSIDER THE following scenario: Law students get together and form a social club. A fellow student gets wind of it and asks to join the club. The leadership at first says yes, but then they find out that the student is a humanist. They reverse themselves and say the club is open to Christians only; furthermore, it's open only to certain types of Christians--those who agree with a fundamentalist faith statement published by the club. If the club were a purely private venture, its discriminatory policies, while annoying, would probably be permitted. But what if the group were receiving financial aid from the law school? What if it had won official recognition from the institution? Should it still be allowed to discriminate? This very issue reached the U.S. Supreme Court in April in a case that has the potential to be a church-state sleeper.
